CONTRACT TERMS

  1. Services.  I’m Cory Ruth, MS, RDN, President of The Women’s Dietitian, APC (“TWD”), and I’m very excited to work with you (TWD’s “Client”)!  TWD will provide only the services included in the online program described on TWD’s website https://www.thewomensdietitian.com/thepcospractice (the “Program”) and paid for by Client. 
  2. Payment.  Full payment, or the first installment of any agreed payment plan, for agreed services is due at least five (5) days prior to our first session.  All health tests will be ordered only after this payment is received, or only after initial payment as part of the payment plan is received. Each payment for the agreed to “payment plan” will be due from Client no later than three (3) days after request is made or bank/credit card is charged. If no payment has been made three (3) days after request or payment fails and is not corrected within three (3) days, TWD has the right to terminate all services.
  3. Rescheduling.  All rescheduling requests must be in writing delivered by email by TWD or Client to the other party.  TWD reserves the right to reschedule a session for any reason. If Client reschedules a session for any reason at least three (3) days in advance, there will be no reduction in the number of sessions Client receives; otherwise that session will be forfeited. Client must use all of their one on one sessions within three (3) months of their initial one on one session; otherwise remaining sessions will be forfeited.  In addition, sessions need to be officially rescheduled to another date (any date agreed upon with you and your coach) within (3) business days of the rescheduling request. If session has not been rescheduled to another date within (3) business days then that session is subject to forfeit. 
  4. Cancelations.  Due to the nature of our services, if client wishes to cancel, no refunds under any circumstances will be given. If TWD cancels service for any reason, a refund of any prepaid but unused fees will be given. Any cancelations of further services must be in writing delivered by TWD to Client.  
  5. Email Communications.  TWD agrees to a maximum of 30 minutes of email communication with Client per week. TWD will keep a running log of time spent reading and responding to email communications from Client.  If our email communications exceed the 30 minutes per week that are included in Client’s package price, TWD will provide Client with written notice and bill Client at the rate of $45.00 for each 10 minutes that our weekly email communications exceed 30 minutes. 
  6. Nature of Services.  Client understands that Cory Ruth, MS, RDN, who provides services to TWD, is a Registered Dietitian licensed to consult in the fields of diet and nutrition, but is not a medical doctor.  TWD cannot and does not practice medicine, provide medical advice, diagnose disease or medical conditions, prescribe or dispense medications, or make recommendations on the cure, prevention, or treatment for medical diseases or conditions.  TWD does not provide medical nutrition therapy (“MNT”).  While the health education, information and advice provided by TWD can supplement medical treatment programs, it should never be used as a substitute for the medical advice of a licensed physician. 
  7. Supplements and Other Medications. Client agrees to provide TWD with a full and

accurate list of Client’s medications, herbs and supplements. Client is advised to consult Client’s physician with regard to TWD’s supplement advice, especially if Client is taking other medications, herbs and/or supplements.  Client understands that allergic reactions to herbs and supplements and/or side effects may occur and are beyond TWD’s control.  Client agrees to take supplement recommendations at Client’s own risk and that the release and hold harmless provisions above apply to any supplement advice given by TWD. 

  1. Confidentiality/Privacy.  All personal information of Client, including the content of medical records and the substance of our consultation sessions, will be held in strict confidence by TWD and will not be disclosed to any third party unless directed by Client in advance in writing delivered by email to TWD.
  2. Limitation of Liability.  Client understands that although TWD’s services are designed to improve Client’s health, TWD cannot and does not warrant or guarantee any particular result.  Client agrees to assume all risks, known or unknown, inherent in relying on nutrition advice and recommendations (including supplements) for any purpose.  Client agrees to release and hold TWD harmless from and against any claims or damages, including any direct, indirect, incidental or consequential damages, that may arise out of or result from services provided by TWD.  THERE CAN BE NO GUARANTEE OF ANY RESULT FROM THE PROGRAM OR ANY ADVICE PROVIDED BY TWD, INCLUDING PREGNANCY, WEIGHT LOSS, OR ANY OTHER HEALTH CONDITION OR BENEFITS.
  3. Dispute Resolution. These contract terms are interpreted and governed by the laws of the U.S. State of Oregon, including its “conflicts of law” rules.  Client understands and agrees that all of TWD’s services are provided in Jackson County, Oregon, regardless of where Client lives or works.  Venue for any dispute between TWD and Client will be in Jackson County, Oregon. 

1:1 Coaching with TWD Payment Plan

This package is divided into (5) monthly payments of $350 USD each for a total of $1750. After these five payments are made, no further payments need to be made!

    Please keep in mind we provide you with a Superbill aka medical receipt to submit to your insurance for potential insurance reimbursement, and also accept FSA/HSA!
